Ana Luísa Guimarães publishes Master's Thesis

Almedina, the leading Portuguese publisher of legal books, recently launched the master’s thesis of SÉRVULO associate Ana Luísa Guimarães. The work, regarding the exceptional character of the administrative contractual act in the Portuguese Public Procurement Code, is a legal analysis of one of the most innovative provisions of the Public Procurement Code. Said provision states that, albeit in expressly exceptional terms, the public contractor may carry out administrative acts against its co-contractor during the implementation of administrative contracts, which translates into a position of superiority and therefore jars with the common framework of contractual parity.

Ana Luísa Guimarães states that “this work is aimed at students of law and legal professionals with links to the field of public procurement, and it wants to go some way to contributing to the understanding of the exact scope of the configuration of the administrative contractual act as an exception. What is mainly at issue here is the evaluation of the extent to which the formal affirmation of exceptionalism by the legislator also means an effective exceptionalism, which in turn requires a sustained systematic, material and dogmatic reconstruction of the scope of the administrative contractual act.”

Ana Luísa Guimarães graduated in Law from the Law Faculty of the University of Coimbra, and has a post-graduation course in Administrative Dispute Resolution from the Lisbon Law School of the Portuguese Catholic University, where she also concluded her Master’s degree in Public Law, area in which she has specialized as a lawyer, focusing primarily matters regarding Public Procurement, and Water and Natural Resources Law.
