Notes on the penalty regime of the Draft Proposal for the General Regulation on Data Protection of the European Parliament and Council

José Lobo Moutinho and David Silva Ramalho, respectively partner and associate of SÉRVULO’s Litigation and Arbitration department, have published an article in the first issue of the journal of the Forum on Data Protection (Fórum de Proteção de Dados), on the penalty regime of the Draft Proposal for the General Regulation on Data Protection of the European Parliament and Council (“Notas sobre o regime sancionatório da Proposta de Regulamento Geral sobre a Protecção de Dados do Parlamento Europeu e do Conselho”). In this paper, the authors analyse the difficulty of interpreting the norms governing the penalty regime included in the current Draft Proposal for the General Regulation on Data Protection, as well as the possible compatibility of these new penalties with the criminal and administrative offenses regime currently in force in Portugal.
