International Compliance 2016: Portugal
BOOKS AND ACADEMIC ARTICLES 2016 in International Compliance, München, C.H. Beck oHG
The book International Compliance, which was recently co-published by C.H. Beck, Hart and Nomos, brings together analyses by compliance specialists from all over the world of the legal and regulatory frameworks of 32 jurisdictions, with a special focus on those areas that are of most importance to business.
The chapter on compliance in Portugal was written by SÉRVULO lawyers, with the coordination of Of Counsel Teresa Serra, and partners Miguel Gorjão-Henriques and Sofia Carreiro.
At a time of financial crisis and one of increase in business-related risks, compliance has taken centre-stage amongst the concerns faced by companies. The need to constantly adapt to legislative changes, aligned with the significant financial and reputational risks resulting from the failure to comply with the norms of evermore regulated sectors, translate into the need, on the part of sector specialists, to maintain a rigorous and focused supervision.
On the chapter on Portugal, SÉRVULO lawyers from the areas of Corporate Crime and Regulatory Compliance, European Law and Competition Law, and Corporate, Commercial & M&A analyse compliance under its diverse legal aspects, from the perspectives of prevention and voluntary compliance, but also from a reactive perspective - on the part of companies and directors - and one of risk management in the cases of law enforcement.
The Portugal chapter also benefited from contributions from partner Rui Cardona Ferreira, associates Ana Moutinho Nascimento, Magda Sousa Gomes, João Carmona Dias, Raul Taborda and Marta Salgado Areias, and trainee José Duarte Coimbra.
