Sérvulo partner Mark Kirkby publishes book on contracts on the exercise of public authority. The work deals in a comprehensive way with the legal regime of a certain type of administrative contracts that is gaining increasing relevance as a tool for concerted implementation of public policies, and even as a mechanism for consensus-building with private entities on how the Administration has powers capable of dealing with the former’s interests and demands.
The Administration increasingly relies on these types of contracts in areas in which the involvement of private entities in the processes of decision-making and task execution turns out to be crucial to increasing the efficiency and results of administrative activity, thereby discrediting unilateral tools of authority that generate public-private disputes, defensiveness and entropy.
The contracts on the exercise of public authority covered in this study have gained a remarkable leading role as a tool of choice of modern Administration in areas such as urban planning and land management, environment, state aid and other public support, and even in those areas that have traditionally been averse to open discussion such as that of tax administration.
